Any terms and conditions of the customer shall only apply if this has been expressly agreed in writing in advance.

2. Customers within the meaning of these General Terms and Conditions may be consumers or businesses. A consumer is a natural person who enters into a legal transaction for purposes that are predominantly outside that person’s commercial or self-employed professional activity. A business is a natural or legal person or a legal partnership that, when entering into the contract, acts in the course of its commercial or self-employed professional activity. The classification of a customer as a consumer or business shall otherwise be governed by the mandatory applicable laws.

II. Contract conclusion

1. The products in the online shop or the placement of the products on the website does not constitute a binding offer to conclude a contract for these products.

2. The customer can choose products from the Seller’s product range (i.e., in particular home grinders, burrs and spare parts for coffee grinders as well as merchandise) and place these in a shopping cart by clicking the “Add to cart” button. Before submitting the order, the customer can change and view the entered data at any time. By clicking the “Place order” button, the customer makes a binding request to purchase the goods in the shopping cart. The customer must first accept the terms and conditions of the contract by clicking the “I accept the Terms and Conditions” button. The Seller will electronically confirm receipt of the order without undue delay.

3. The customer will then receive an order confirmation from the Seller. The contract is concluded with the order confirmation, which represents the acceptance of the order. In this email, but no later than upon delivery of the goods, the terms and conditions of the contract shall be sent to the customer on a permanent data carrier (email or paper printout). The Seller will store the text of the contract in accordance with the applicable laws.

4. The contract is concluded in the language of the website version through which the customer places the order.

III. Delivery

1. Delivery takes 5 business days, unless no or a deviating delivery period is indicated on the website. The delivery period begins upon receipt of the order confirmation, provided that the purchase price or any agreed advance payment has been received on time.

2. Goods shall be shipped by FedEx, DHL or Royal Mail. For consumers, the risk of accidental loss or accidental damage to the goods generally passes to the consumer only upon delivery of the goods to the consumer or a third party designated by the consumer, unless mandatory law provides otherwise. For businesses, the risk passes to the customer upon delivery of the goods to the carrier, unless mandatory law provides otherwise.

3. The following delivery restrictions apply: The Seller delivers to the countries listed as delivery destinations on the website from time to time. As of the date of conclusion of the contract, these include, in particular, the Member States of the European Union, Switzerland, the United Kingdom, and Turkey, provided that the respective delivery destination can be selected in the online shop. Delivery to certain territories or countries may be excluded for legal, logistical, or other objective reasons.

IV. Prices and shipping costs

1. All prices stated on the website include, where offered to consumers, the applicable sales, value-added, or other applicable sales taxes. Different tax rules may apply to businesses depending on the customer’s location, the nature of the transaction, and the applicable tax laws. The prices and taxes shown during the ordering process shall be controlling.

2. The applicable shipping costs will be stated in the order form and shall be borne by the customer unless otherwise provided by applicable law or these General Terms and Conditions.

3. In the event of a withdrawal or exercise of a corresponding statutory or contractual right of cancellation, the consumer shall bear the direct costs of returning the goods to the extent permitted by applicable law and provided that the consumer was properly informed of this before conclusion of the contract.

V. Payment methods

1. The following payment methods are available to the Customer: PayPal, Visa, Mastercard, American Express, Klarna, iDEAL | Wero, Bancontact, TWINT, Google Pay and Apple Pay. The availability of individual payment methods may depend on the Customer’s location and other requirements. If the Customer has a user account, the Customer may change the saved payment method at any time.

2. Payment of the purchase price shall be due immediately upon conclusion of the contract, unless another payment term has been determined by the Seller.

3. In the event of late payment, the Seller is entitled to claim the statutory default interest and other damages resulting from late payment under the applicable law.

4. The customer’s obligation to pay default interest does not preclude the Seller from claiming additional damages resulting from late payment to the extent permitted by applicable law.

VI. Retention of title

The goods remain the property of the Seller until full payment has been received, to the extent that retention of title can be validly agreed under the applicable law.

VII. RIGHT OF WITHDRAWAL

Consumers shall have the statutory rights of withdrawal, cancellation and other rights relating to the unwinding of contracts that are mandatorily applicable to distance contracts. The provisions below contain information on the exercise of, and the consequences of, a right of withdrawal, insofar as such a right exists under the applicable law. No additional contractual right of withdrawal shall be granted.

Withdrawal policy

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party designated by you who is not the carrier takes possession of the goods or, in the case of an order for multiple goods that are delivered separately, the last goods.

To exercise your right of withdrawal, you may use our electronic withdrawal function available via the following link: WITHDRAW FROM CONTRACT

Using the electronic withdrawal function, you can submit your withdrawal declaration easily and directly online. After submitting your withdrawal declaration, you will promptly receive an electronic confirmation of receipt including the date and time of receipt.

Alternatively, you may inform us (Hemro International AG, Thurgauerstrasse 80, 8050 Zürich, Switzerland, Tel.: +41 44 864 18 00, e-mail: shop@mahlkoenig.com) of your decision to withdraw from this contract by means of a clear declaration (e.g. a letter sent by post or an email).

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including delivery costs (except for additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and in any event no later than fourteen days from the day on which we receive notification of your withdrawal from this contract.

For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you. In no event will you incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is earlier.

You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

You shall bear the direct costs of returning the goods to the extent permitted by applicable law and provided that we properly informed you of this before conclusion of the contract.

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

End of withdrawal policy

VIII. Legal Guarantee and Commercial Guarantee

1. All goods offered in our online shop are subject to the statutory rights of consumers in the event of defects or lack of conformity of the goods, as mandatorily applicable in each case.

2. The scope, periods and specific form of these statutory rights shall be governed by the mandatory statutory provisions of the country in which the consumer has their habitual residence. Mandatory consumer protection provisions of that country that are more favourable to the consumer shall remain unaffected.

3. For consumers in the European Union, the legal guarantee period for goods is generally at least two (2) years from delivery. To the extent that the mandatory applicable law provides for longer periods or additional rights, these shall remain unaffected. Consumers can find an overview of the legal guarantee rights in the Member States of the European Union here.

4. If the goods are defective or do not conform to the contract, the consumer shall have the rights provided for under the mandatory applicable law. These include, in particular, free repair or replacement and, where applicable, a reduction in the price or termination of the contract and reimbursement of the purchase price, in each case in accordance with the applicable statutory provisions.

5. Consumers in the European Union will be provided with the standardised harmonised notice on the legal guarantee in the form prescribed by law and prior to the conclusion of the purchase contract in the online shop.

6. For purchases by businesses, the limitation period for claims based on defects or lack of conformity of the goods shall be twelve (12) months from delivery of the goods. This shall not apply to claims arising from injury to life, body or health, in cases of intent or gross negligence, in cases of fraudulent concealment of a defect, or to claims based on an expressly assumed guarantee.

7. A commercial guarantee for the goods supplied by the seller that goes beyond the statutory legal guarantee rights shall only exist if the seller has issued a guarantee statement for the respective item. The guarantee statement must specify, in particular, the guaranteed performance, the duration and territorial scope of the guarantee, as well as the requirements for invoking the guarantee and the procedure for asserting claims under the guarantee.

IX. Liability

1. The Seller shall be liable in accordance with the applicable laws for damages caused by willful misconduct or gross negligence on the part of the Seller, its legal representatives, or agents.

2. In the event of a slightly negligent breach of material contractual obligations, the Seller shall be liable in accordance with the applicable laws, provided that such liability is limited to the foreseeable and typical damages that could reasonably have been anticipated at the time the contract was concluded, to the extent such limitation is permitted by law.

3. The foregoing limitations of liability shall not apply to the extent mandatory law provides otherwise, in particular to damages arising from injury to life, body, or health, in cases of willful misconduct, or to the extent the Seller has assumed a guarantee.

4. Mandatory statutory liability provisions, in particular those protecting consumers and those relating to product liability, shall remain unaffected.

X. Data protection

For details regarding the processing of personal data by the respective Seller, please refer to the Privacy Policy (see website).

XI. Final provisions

1. Contracts between the Seller and the Customer shall be governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If the customer is a consumer, however, this governing law shall not result in the customer being deprived of the protection of the mandatory provisions of the law of the country in which they have their habitual residence.

2. For all disputes arising out of or in connection with the contractual relationship with businesses, Hamburg, Germany, shall be the exclusive place of jurisdiction, to the extent permitted by applicable law. With respect to consumers, the statutory rules on jurisdiction shall apply.
